Welcome to Therese Travel & Tours. By accessing our website or engaging our travel planning services, you agree to be bound by the following Terms of Service. Please read them carefully. If you do not agree with any part of these terms, please do not use our services.
1. Services
Therese Travel & Tours provides travel consulting, custom itinerary design, flight and logistics coordination, and related travel planning services. Our services are offered on a consulting basis and do not constitute a travel agency, tour operator, or booking platform unless explicitly stated in a separate written agreement. We act as an independent travel advisor on your behalf.
2. Eligibility
You must be at least 18 years of age to engage our services or enter into any agreement with us. By using our website or contacting us for services, you represent that you meet this requirement.
3. Consulting Plans & Fees
Fees for consulting plans (Essential, Signature, Basic Subscription, and Premium Subscription) are clearly stated on our Consulting page and are subject to change without notice. All fees are in US dollars. Payment terms, refund eligibility, and plan inclusions are communicated at the time of purchase. Consulting fees cover advisory services only and do not include the cost of flights, accommodations, tours, visas, travel insurance, or any third-party services.
4. Bookings & Third-Party Providers
When Therese Travel & Tours assists with booking flights, hotels, tours, or cruises on your behalf, those bookings are made with third-party providers subject to their own terms and conditions, cancellation policies, and pricing. We are not responsible for changes, cancellations, delays, or service failures by airlines, hotels, cruise lines, or other third-party vendors. We strongly recommend purchasing comprehensive travel insurance.
5. Cancellations & Refunds
Consulting fees paid for completed itinerary work are non-refundable once the deliverable has been provided. For subscription plans, you may cancel at any time; cancellation takes effect at the end of the current billing period with no prorated refunds. If we are unable to deliver agreed services due to circumstances on our end, we will work with you in good faith to provide a fair resolution.
6. Travel Insurance
We strongly recommend that all clients purchase comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and baggage loss before any travel. Therese Travel & Tours is not liable for losses that could have been covered by travel insurance.
7. Accuracy of Information
We strive to provide accurate and up-to-date information about destinations, itineraries, and travel requirements. However, travel conditions, visa requirements, entry restrictions, and local regulations can change rapidly. It is your responsibility to verify current requirements with relevant embassies, airlines, and government authorities before travel.
8. Limitation of Liability
To the fullest extent permitted by law, Therese Travel & Tours and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to lost profits, travel disruptions, personal injury, or property damage occurring during travel. Our total liability for any claim related to our services shall not exceed the consulting fees paid by you in the three months preceding the claim.
9. Intellectual Property
All content on this website — including text, itineraries, images, and design — is the property of Therese Travel & Tours and may not be reproduced, distributed, or used without prior written permission.
10. Privacy
We collect and use personal information you provide solely for the purpose of delivering our travel planning services. We do not sell or share your personal information with third parties except as necessary to fulfill your travel arrangements (e.g., providing your details to airlines or hotels for bookings). 11. Governing Law
These Terms of Service are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Santa Clara County, California.
12. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
